Court of Appeal set to decide on disability abortion challenge

The Court of Appeal is due to decide whether campaigner Heidi Crowter can continue her fight against disability discrimination in abortion law.

On Tuesday 8 March, the Court will listen to oral arguments in a two-hour hearing with a decision expected soon after.

Heidi is seeking permission to appeal an earlier decision by the High Court in September last year, where judges rejected her legal challenge to current abortion laws.

Heidi launched a case against the current abortion laws which allow for abortion up to birth for ‘serious disability’ which has been interpreted to include cleft lip, club foot and Down syndrome.

However, in a controversial ruling, the High Court rejected the case in September last year.

Heidi and her team asked the High Court to reconsider but judges refused, insisting they were right in their original ruling.

So, Heidi went to the Court of Appeal to seek permission to appeal the High Court’s ruling.
